Welcome to hho (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our cryptocurrency swap services (the “Services”) provided through our website, mobile application, or other platforms (collectively, the “Platform”). By accessing or using our Services, you (“you” or “User”) agree to be bound by these Terms. If you do not agree with these Terms, you must not use our Services.
1. Description of Services
hho provides a non-custodial platform that allows you to swap cryptocurrencies on the supported blockchain networks. We facilitate these transactions by routing your swap requests through decentralized protocols based on atomic swaps and smart contracts. We do not hold, store, or take custody of your cryptocurrencies at any time.
2. Eligibility
- Be at least 18 years old or the age of majority in your jurisdiction.
- Not be located in, or be a resident of, any jurisdiction where use of our Services is prohibited by law or regulation.
- Not use our Services for any illegal or unauthorized purpose.
We do not collect Know Your Customer (KYC) information or verify user identities, but you are responsible for ensuring your use of the Services complies with all applicable laws in your jurisdiction.
3. User Responsibilities
- Provide Accurate Information: Ensure that wallet addresses and other transaction details you provide are accurate. We are not responsible for losses due to incorrect or invalid wallet addresses.
- Secure Your Assets: Maintain the security and confidentiality of your wallet private keys and other sensitive information. We do not have access to or control over your private keys.
- Comply with Laws: Use the Services in compliance with all applicable local, national, and international laws, including tax and anti-money laundering regulations.
- Accept Blockchain Risks: Acknowledge that cryptocurrency transactions are recorded on public blockchains, which are transparent and immutable, and that transaction details (e.g., wallet addresses) may be publicly visible.
4. No KYC or User Verification
We do not collect KYC information or perform identity verification. You are solely responsible for ensuring that your use of the Services complies with any legal or regulatory requirements in your jurisdiction, including any obligations related to identity verification or transaction reporting.
5. Prohibited Activities
You may not use the Services to:
- Engage in illegal activities, including but not limited to money laundering, terrorist financing, or fraud.
- Attempt to reverse, cancel, or manipulate completed transactions, as blockchain transactions are irreversible.
- Use automated tools, bots, or scripts to interfere with the Platform’s functionality or security.
- Violate the intellectual property rights of hho or any third party.
- Engage in any activity that could harm, disrupt, or overload the Platform.
6. Fees
Our Services may incur fees for processing cryptocurrency swaps, which will be clearly displayed before you confirm a transaction. Fees may include network fees (e.g., gas fees) charged by blockchain networks, which are outside our control. You are responsible for all fees associated with your transactions.
7. Risks
- Cryptocurrency Volatility: Cryptocurrency prices are highly volatile, and the value of assets swapped may change significantly during or after a transaction.
- Blockchain Risks: Transactions are subject to the risks of blockchain networks, including network congestion, high fees, or failed transactions.
- Irreversibility: Blockchain transactions are irreversible. We cannot recover or refund assets sent to incorrect wallet addresses or lost due to user error.
- Regulatory Risks: Cryptocurrency regulations vary by jurisdiction and may change, potentially affecting your ability to use our Services.
- Security Risks: While we implement industry-standard security measures, you are responsible for securing your devices, wallets, and private keys.
8. No Warranties
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether expressed or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee:
- The availability, accuracy, or reliability of the Platform.
- The completion or success of any transaction, as blockchain networks are outside our control.
- The security of your cryptocurrencies, which you control through your private keys.
9. Limitation of Liability
To the fullest extent permitted by law, hho, its affiliates, and its service providers shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
- Your use of or inability to use the Services.
- Losses due to incorrect wallet addresses, network failures, or user errors.
- Unauthorized access to your wallets or private keys.
- Changes in cryptocurrency prices or market conditions.
- Regulatory actions or legal restrictions affecting your use of the Services.
Our total liability, if any, shall not exceed the fees you paid for the specific transaction giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless hho, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, or liabilities arising from your use of the Services, violation of these Terms, or violation of any applicable laws.
11. Termination
We may suspend or terminate your access to the Services at our sole discretion, with or without notice, if we believe you have violated these Terms or if required by law. You may stop using the Services at any time.
12. Intellectual Property
All content, trademarks, and intellectual property on the Platform are owned by hho or its licensors. You may not copy, modify, distribute, or use our intellectual property without our prior written consent.
13. Third-Party Services
Our Services may interact with third-party services, such as blockchain networks or wallet providers, which are not controlled by us. We are not responsible for their performance, availability, or practices. You should review their terms and policies before using them.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Hong Kong, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. You waive any right to participate in class actions or class-wide arbitration.
15. Changes to These Terms
We may update these Terms at any time by posting the revised version on our Platform. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
